法律分析：一个人不能同时拥有两个村的土地承包经营权，也不能都进行确权。只有本集体经济组织的农户，才能拥有本农村集体经济组织的土地承包经营权。
法律依据：《中华人民共和国农村土地承包法》 第十五条 家庭承包的承包方是本集体经济组织的农户。农村土地确权是以已经签订的二轮土地承包合同和已经颁发的土地承包经营权证书为基础，以此次登记前最近的承包关系为依据，参照二调成果对土地面积进行校准。
