释义	法律分析：拾得者明知是他人遗失物，以不给失主为要挟向对方索要财物，属敲诈勒索行为，若遗失物价值达到敲诈勒索罪的立案标准，则可以按敲诈勒索罪立案。法律依据：《中华人民共和国民法典》第三百一十五条有关部门收到遗失物，知道权利人的，应当及时通知其领取知道的，应当及时发布招领公告。第三百一十六条拾得人在遗失物送交有关部门前，有关部门在遗失物被领取前，应当妥善保管遗失物。因故意或者重大过失致使遗失物毁损、灭失的，应当承担民事责任。
