释义	法律分析：行为人在婚姻关系存续期间出轨而被发现的，可以主动断绝外遇关系，转而继续维护家庭关系，也可以自行提出离婚。与另一方协议离婚的，必须到婚姻登记机关申请离婚，并且已经对子女和财产问题进行适当处理。诉讼离婚的，则法院认为双方感情确已破裂，并且调解无效，则准予离婚。离婚时双方必须到婚姻登记机关申请离婚。法律依据：《中华人民共和国民法典》第一千零五十一条有下列情形之一的，婚姻无效：（一）重婚；（二）有禁止结婚的亲属关系；（三）未到法定婚龄。
