一、对方出轨如何要精神损害赔偿
1、《民法典》规定对方出轨不一定会有精神损害赔偿，无过错方作为被告的离婚诉讼案件，如果被告不同意离婚也不提起离婚损害赔偿请求的，可以在离婚后一年内单独就请求损害赔偿提起诉讼。
2、根据《中华人民共和国民法典》第一千零九十一条，有下列情形之一，导致离婚的，无过错方有权请求损害赔偿：
(一)重婚;
(二)与他人同居;
(三)实施家庭暴力;
(四)虐待、遗弃家庭成员;
(五)有其他重大过错。
第一千零九十二条，夫妻一方隐藏、转移、变卖、毁损、挥霍夫妻共同财产，或者伪造夫妻共同债务企图侵占另一方财产的，在离婚分割夫妻共同财产时，对该方可以少分或者不分。

第八十九条，当事人在婚姻登记机关办理离婚登记手续后，以民法典第一千零九十一条规定为由向人民法院提出损害赔偿请求的，人民法院应当受理。但当事人在协议离婚时已经明确表示放弃该项请求的，人民法院不予支持。
二、最新精神损害赔偿计算标准是怎样的
1、对于造成死亡的，应当赔偿死亡赔偿金;
2、对于造成残疾的，应当赔偿残疾赔偿金;
3、对于侵害人身，没有造成死亡残疾后果的，应当赔偿精神抚慰金。
