法律分析：
法律没有规定的，可以适用习惯，但是不得违背公序良俗。原《中华人民共和国民法通则》规定，没有法律规定的，应当遵守国家政策，《中华人民共和国民法典》第十条删除了“国家政策”作为法源的规定，因为在政策成为现行法律之前，是不具有规范性和国家强制性的，不能在法院裁判中作为判决依据。
法律依据：
《中华人民共和国民法典》 第十条 处理民事纠纷，应当依照法律；法律没有规定的，可以适用习惯，但是不得违背公序良俗。
