释义	法律分析: 索要分手费不合法。分手费并不是合法的债务关系，恋人没有义务支付。从法律层面看，分手费并不属于同居期间的共同财产、或合法的赠与、债务债权关系，因此索要分手费是不合法的。特别是婚内出轨，当第三者的，通过分手获取分手费，更不能得到法律保护和支持。法律依据:《《中华人民共和国民法典》》第一千一百六十五条【过错责任原则】行为人因过错侵害他人民事权益造成损害的，应当承担侵权责任。依照法律规定推定行为人有过错，其不能证明自己没有过错的，应当承担侵权责任。
