释义	法律分析：肖像权，是指自然人对自己的肖像享有再现、使用并排斥他人侵害的权利。未经本人同意，不得以营利为目的使用公民的肖像。可以看出构成侵害肖像权的要件(必要条件)包括两点：1、未经本人同意;2、以营利为目的。法律依据：《中华人民共和国民法典》第一百一十条自然人享有生命权、身体权、健康权、姓名权、肖像权、名誉权、荣誉权、隐私权、婚姻自主权等权利。法人、非法人组织享有名称权、名誉权和荣誉权。
