企业不给生育津贴怎么办

法律分析：
生育津贴是由用人单位统一申领，再发放给职工的，如果公司不按照规定发放，职工可以向劳动行政部门投诉，劳动行政部门应当依法处理。
法律依据：
《企业职工生育保险试行办法》 第十三条 企业虚报、冒领生育津贴或生育医疗费的，社会保险经办机构应追回全部虚报、冒领金额，并由劳动行政部门给予处罚。企业欠付或拒付职工生育津贴、生育医疗费的，由劳动行政部门责令企业限期支付；对职工造成损害的，企业应承担赔偿责任。
