释义	法律分析：根据法律规定，约定个人借款利息的利率可适当高于银行利率，但最高不得超过银行同类贷款利率的36%(含利率本数)。否则超过部分的利息不受保护。法律依据：《中华人民共和国民法典》第六百八十条自然人之间的借款合同对支付利息没有约定或者约定不明确的，视为不支付利息。公民之间的个人借款如果没有约定利息，就视为没有利息。欠条，没有约定的，也是没有利息，但是过了还款日，没有还的，到时可以要求按银行利息计算。
