释义	虐待罪的立案标准是：对于虐待家庭成员，致使被害人重伤、死亡的，则属于公诉案件，公安机关应当立案侦查。不是法律规定的情形，本罪属于告诉才处理的自诉案件，一般采取不告不理的原则，被虐待人可以直接向人民法院提起诉讼。【法律依据】《中华人民共和国刑法》第二百六十条第一款、第二款、第三款虐待家庭成员，情节恶劣的，处二年以下有期徒刑、拘役或者管制。犯前款罪，致使被害人重伤、死亡的，处二年以上七年以下有期徒刑。第一款罪，告诉的才处理，但被害人没有能力告诉，或者因受到强制、威吓无法告诉的除外。
