释义	法律分析：不能。房产抵押时，如果是转让方式取得土地使用权的，其所依附的国有土地使用权实际上已经同时抵押了。如果是划拨方式取得的土地使用权，根本就无权抵押；对于集体土地使用权而言，国家规定不得单独抵押。法律依据：《中华人民共和国民法典》第三百九十七条以建筑物抵押的，该建筑物占用范围内的建设用地使用权一并抵押。以建设用地使用权抵押的，该土地上的建筑物一并抵押。抵押人未依据前款规定一并抵押的，未抵押的财产视为一并抵押。
