释义	法律分析：拿离婚证并不一定要冷静期，是否有冷静期要根据选择离婚的方式而定，“冷静期”制度并不适用所有的离婚情形，发生家暴或婚内出轨现象，确实导致感情破裂，到法院去离婚的话，就没有所谓的“冷静期”适用问题。法律依据：《中华人民共和国民法典》第一千零七十七条自婚姻登记机关收到离婚登记申请之日起三十日内，任何一方不愿意离婚的，可以向婚姻登记机关撤回离婚登记申请。前款规定期限届满后三十日内，双方应当亲自到婚姻登记机关申请发给离婚证；未申请的，视为撤回离婚登记申请。
