3.《保险法》第一百七十三条：保险人应当在保险金属于给付范围的情况下，在被保险人提出赔付请求之日起十五日内予以答复。保险人拒绝承担给付责任的，应当同时说明理由和依据，并告知被保险人有权向保险监管部门或者人民法院提出申诉或者起诉。
4.《保险法》第一百七十四条：被保险人请求保险金的时效期间为二年，自知道或者应当知道保险事故发生之日起计算。但是，保险合同另有约定的除外。
5.《保险法》第一百七十五条：保险人拒绝承担给付责任或者提出给付金额低于被保险人要求的，被保险人应当在三十日内向保险人提出书面异议。异议不成的，被保险人可以向人民法院提起诉讼。
