释义	法律分析：出借人死了不是谁都可以拿着借条讨债的。债务人死亡后，债务人生前所负债务应该由其继承人在所继承遗产的范围内对其予以偿还，但是继承人放弃继承的除外。做为出借人可以起诉借款人的继承人，要求履行债务。出借人死了不代表债务也就没有了，因此借条还是可以继续生效，债权人是有权拿着借条跟出借人的亲属要求还钱的。法律依据：《中华人民共和国民法典》第一千一百五十九条分割遗产，应当清偿被继承人依法应当缴纳的税款和债务；但是，应当为缺乏劳动能力又没有生活来源的继承人保留必要的遗产。
