释义	法律分析：当事人采用合同书形式订立合同的，自双方当事人签字或者盖章时合同成立。合同成立与合同生效不是一回事．根本区别是：成立的合同不一定有效，而有效的合同必然已经成立．换句话说：合同有效是以合同成立为前提的．仅成立而没有生效的合同，对当事人没有约束力．依法成立的合同，自成立时生效。法律、行政法规规定应当办理批准、登记等手续生效的，依照其规定。法律依据：《中华人民共和国民法典》第一百一十九条依法成立的合同，对当事人具有法律约束力。
