释义	法律分析：不适用。我国劳动法规定，60岁的劳动者已经达到法定退休年龄，劳动合同自然终止，双方终止劳动关系，单位不需要支付经济补偿金。如果单位继续留用，双方应当签订劳务合同或者聘用合同，双方不再受劳动法、劳动合同法约束。法律依据：《中华人民共和国劳动合同法》第四十八条用人单位违反本法规定解除或者终止劳动合同，劳动者要求继续履行劳动合同的，用人单位应当继续履行；劳动者不要求继续履行劳动合同或者劳动合同已经不能继续履行的，用人单位应当依照本法第八十七条规定支付赔偿金。
