释义	如果构成重婚罪，将承担刑事责任，没有构成重婚罪，则不处罚。根据我国相关法律规定，有配偶一方与婚外情人之间有新的法律婚姻关系或者事实婚姻关系，将构成重婚罪，双方都将处二年以下有期徒刑或者拘役。但即使有配偶一方与婚外情人有出轨行为但不构成重婚罪的，我们就不能对其进行相应的处罚。法律依据：《刑法》第二百五十八条规定：有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
