释义	婚姻第三者一般不算是违法的，但是如果构成重婚的，属于犯罪。如果有配偶者与婚外异性公然以夫妻名义共同生活的，则构成重婚，出轨等有可能是偶然情况，因此不一定构成重婚。构成重婚的情形有两种：一是配偶的双方或一方，婚姻关系尚未解除，又与他人办理结婚登记；二是虽未办理结婚登记，但在事实上同他人以夫妻名义同居生活。【法律依据】《刑法》第二百五十八条，有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
