生产队地归生产队还是归村里
释义
法律分析：土地收回应该归村集体，所有的土地的所有权都归国家，你们村里，村委代表村集体，生产队如果和村里意见一致的时候，可以参与分配。如果和村委的意见相悖的时候，和村民的意见相悖的时候，生产队是不能够在要回当年支出的土地的。如果是有协议，或者是协议不到期的话，可以给村里提要求，谁违约，谁负责赔偿。
法律依据：《中华人民共和国农村土地承包法》 第二十八条 预留的土地，属于集体经济组织，一般指的是村委会，看你们的农村土地联产承包的发包主体是村委会还是村小组。
