释义	对象不能犯未遂不一定是无罪，若是犯罪情节显著轻微、危害不大，不认为是犯罪的，可以是无罪。对象不能犯，是指具体的犯罪对象不存在，行为人误以为存在而实施犯罪行为，因而致使犯罪未得逞，应定为犯罪未遂。法律依据：《中华人民共和国刑法》第十四条明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。第二十三条已经着手实行犯罪，由于犯罪分子意志以外的原因而未得逞的，是犯罪未遂。对于未遂犯，可以比照既遂犯从轻或者减轻处罚。
