释义	法律分析：根据我们国家的规定,如果是一方丧偶,这种情况下不需要办理离婚手续,只需要出具丧偶的证明就能够在民政局重新办理结婚的手续,所以说丧偶是不需要办理离婚的手续的,因为一方丧偶的情况下,婚姻关系就已经自动不再存在了,已经消灭了。法律依据：《中华人民共和国民法典》第五十一条被宣告死亡的人的婚姻关系，自死亡宣告之日起消除。死亡宣告被撤销的，婚姻关系自撤销死亡宣告之日起自行恢复。但是，其配偶再婚或者向婚姻登记机关书面声明不愿意恢复的除外。
