释义	童工是指未满16周岁，与单位或者个人发生劳动关系从事有经济收入的劳动或者从事个体劳动的少年、儿童。劳动法没有规定17岁不能参加工作。我国劳动法和未成年人保护法都是限制招收不满十六周年的童工。因此，满了十七岁不算童工。法律依据《劳动法》第九十四条，用人单位非法招用未满十六周岁的未成年人的，由劳动行政部门责令改正，处以罚款；情节严重的，由市场监督管理部门吊销营业执照。
