释义	法律分析：不合法。代孕技术的实施具有严重的社会危害性，涉及社会、道德、法律等一系列问题，与现行的法律、法规、伦理和社会道德相违背。我国明令禁止任何形式的代孕技术。卫生行政部门将严肃查处任何非法实施代孕技术的医疗机构和医务人员。法律依据：《人类辅助生殖技术管理办法》第三条人类辅助生殖技术的应用应当在医疗机构中进行，以医疗为目的，并符合国家计划生育政策、伦理原则和有关法律规定。禁止以任何形式买卖配子、合子、胚胎。医疗机构和医务人员不得实施任何形式的代孕技术。
