释义	法律分析：不能。保险公司可以在中华人民共和国境内外设立分支机构，但必须经金融监督管理部门批准，取得分支机构经营保险业务许可证。保险公司的分支机构不具有法人资格，其民事责任由保险公司承担。法律依据：《中华人民共和国民法典》第一百二十条民事权益受到侵害的，被侵权人有权请求侵权人承担侵权责任。第一百八十三条因保护他人民事权益使自己受到损害的，由侵权人承担民事责任，受益人可以给予适当补偿。没有侵权人、侵权人逃逸或者无力承担民事责任，受害人请求补偿的，受益人应当给予适当补偿。
