释义	法律分析：外资企业在经营期内不得减少其注册资本。但是，因投资总额和生产经营规模等发生变化，确需减少的，须经审批机关批准。法律依据：《中华人民共和国外商投资法实施条例》第三十七条外商投资企业的登记注册，由国务院市场监督管理部门或者其授权的地方人民政府市场监督管理部门依法办理。国务院市场监督管理部门应当公布其授权的市场监督管理部门名单。外商投资企业的注册资本可以用人民币表示，也可以用可自由兑换货币表示。
