释义	法律分析：两违建筑是违法用地、违法建设的建筑的简称。所谓“两违”建筑，是指未经批准占用土地擅自建房的行为和没有取得建设工程规划许可证或者违反建设工程规划许可证核定的建房行为。建设单位在建造建筑物之前应取得建设用地使用权，否则该建筑物构成违章建筑。法律依据：《中华人民共和国土地管理法》第五十三条经批准的建设项目需要使用国有建设用地的，建设单位应当持法律、行政法规规定的有关文件，向有批准权的县级以上人民政府土地行政主管部门提出建设用地申请，经土地行政主管部门审查，报本级人民政府批准。
