释义	法律分析：反诉主张的诉求不能得到法院支持,本诉判决义务要承担.不服可以上诉法律依据：《中华人民共和国刑事诉讼法》第二百零七条自诉案件的被告人在诉讼过程中，可以对自诉人提起反诉。反诉适用自诉的规定。在自诉案件审理过程中，自诉案件的被告人或其法定代理人向受理自诉案件的人民法院控告自诉人犯有与本案有关联的犯罪行为，要求人民法院追究其刑事责任的诉讼即为反诉。反诉以自诉存在为前提，但反诉本身不是对自诉的答辩，而是一个独立的诉讼。
