释义	法律分析：聘用合同是广义上劳动合同的一种特殊形式，具有劳动合同的基本特征，其基本制度与劳动合同相一致。但是，由于事业单位的特点以及目前国家对事业单位的管理在一些方面仍有别于企业，所以又与狭义劳动合同（企业劳动合同）有一定的区别。法律依据：《中华人民共和国劳动合同法》第十条建立劳动关系，应当订立书面劳动合同。已建立劳动关系，未同时订立书面劳动合同的，应当自用工之日起一个月内订立书面劳动合同。用人单位与劳动者在用工前订立劳动合同的，劳动关系自用工之日起建立。
