释义	法律客观：公益捐赠或救灾捐赠的捐赠人的捐赠带有很强的目的性，依据我国《合同法》的规定，一般的赠与合同赠与人在赠与财产的权利转移之前可以撤销赠与，而具有救灾、扶贫等社会公益、道德义务性质的捐赠，赠与人不享有撤销权。如果赠与人不交付赠与财产的，受赠人可以要求赠与人交付。捐赠人不是直接将捐赠款物赠与给受益人，而是捐赠人将捐赠款物赠与给公益性社会团体、公益性非营利的事业单位或民政部门，由这些机构按照自身的服务宗旨，来管理和使用捐赠的款物，对受灾群众进行必要的救助。
