非婚生子是重婚罪吗

释义

法律主观：

非婚生子不属于重婚罪。法律规定，只有当事人在有配偶的情况下与他人登记结婚或者是与他人在外以夫妻名义同居才构成重婚罪。如果当事人没有实施上述行为，只是与他人非婚生子的，依法不触犯重婚。

法律客观：

《中华人民共和国民法典》第一千零四十二条禁止包办、买卖婚姻和其他干涉婚姻自由的行为。禁止借婚姻索取财物。禁止重婚。禁止有配偶者与他人同居。禁止家庭暴力。禁止家庭成员间的虐待和遗弃。
