释义	法律分析：分两种情况。胎儿出生时为死体的，原保留的遗产份额仍视为被继承人尚未分割的遗产，由被继承人的继承人依法分配果该胎儿出生时为活体，但不久后死亡，则原来为其保留的遗产份额应当属于胎儿的遗产，由他的法定继承人依法定继承方式继承。法律依据：《中华人民共和国民法典》第十六条涉及遗产继承、接受赠与等胎儿利益保护的，胎儿视为具有民事权利能力。但是，胎儿娩出时为死体的，其民事权利能力自始不存在。
