释义	法律分析：不合法。劳动者正常辞职需要提前30天通知用人单位，与是否签订劳动合同无关。如果拖欠工资，可以申请劳动仲裁或劳动监察投诉。劳动者辞职不需要用人单位的同意。有三种情况：1、正常辞职的情况。法律依据：《中华人民共和国劳动合同法》第三十七条劳动者提前30天书面提出辞职，不需要用人单位批准第31天就可以离职。其中，试用期提前3天书面提出；用人单位有义务结清工资并办理离职手续。2、即时辞职，即所谓的快辞。
