释义	法律分析: 无民事行为能力人不能放弃继承。因为我国法律明确规定，无民事行为能力人是不能辨认自己行为的成年人，由其法定代理人代理实施民事法律行为。其单独实施的民事法律行为无效。所以无民事行为能力人放弃继承也是无效的。法律依据:《《中华人民共和国民法典》》第一千一百二十三条继承开始后，按照法定继承办理；有遗嘱的，按照遗嘱继承或者遗赠办理；有遗赠扶养协议的，按照协议办理。
