释义	法律分析：民间借款中，款项的交付比借据更重要，如果双方订立了借款合同或写有借条的，没有实际交付借款的，合同只是成立，但没有生效。在小额借款中，如果出借人仅有借条的，此时借条即是借贷的合意，又是交付借款的凭证，因为小额借款中，根据一般的生活常理，无需出借人再另行提供转账凭证作为交付的事实。在较大金额的借贷中，出借人仅借条在手，法院不会支持。法律依据：《中华人民共和国民法典》第六百七十九条自然人之间的借款合同，自贷款人提供借款时成立。
