释义	商标行政诉讼的管辖确定标准是什么行政诉讼法第十八条规定：“行政案件由最初作出具体行政行为的行政机关所在地人民法院管辖。经复议的案件，复议机关改变原具体行政行为的，也可以由复议机关所在地人民法院管辖。”这一规定表明，一般情况下行政案件是由被告所在地的人民法院管辖。同时，行政诉讼法第二十五条规定，两个以上行政机关作出同一具体行政行为的，共同用出具体行政行为的行政机关是共同被告。对此，行政诉讼法第二十条规定：“两个以上人民法院都有管辖权的案件，原告可以选择其中一个人民法院提起诉讼的，由最先收到起诉的人民法院管辖。” 商案件进行调查，执行县级工商行政管理机关的处理决定，被处罚人不服提起行政诉讼的，派出工商所的县级工商行政管理机关为被告。商标行政诉讼的范围公民、法人或其他组织“认为行政机关侵犯其人身权、财产权的”可以提起行政诉讼。当事人对所有涉及到财产权的处罚不服，都可以提起诉讼。就商标行政诉讼案件讲，根据商标法及其细则规定，当事人对工商行政管理机关对下列7项行为处罚不服的，可以提起行政诉讼。 1、使用商标的商标商品粗制造，以次充好，欺骗消费者的； 2、国家规定必须使用注册商标的商品，没有使用注册商标在市场上销售的； 3、未注册商标冒充注册商标使用的； 4、使用的商标属于商标法规定，不得作为商标使用的文字、图形的； 5、侵权注册商标专用权，工商行政管理机关责令停止侵权行为、罚款； 6、对有毒、有害并且没有使用价值的商品予以销毁的； 7、封存或者收缴商标标识的。
