释义	法律分析：小产权房本身不违法。如果是在没有得到有关部门的审批，没取得土地使用证、规划许可证、施工许可证的情况下，进行非法建设然后进行销售小产权房的，这种销售行为是违法的。法律依据：《中华人民共和国城市房地产管理法》第六十三条经省、自治区、直辖市人民政府确定，县级以上地方人民政府由一个部门统一负责房产管理和土地管理工作的，可以制作、颁发统一的房地产权证书，依照本法第六十一条的规定，将房屋的所有权和该房屋占用范围内的土地使用权的确认和变更，分别载入房地产权证书。
