释义	法律分析: 1、以事实为根据，以法律为准绳。司法机关处理一切案件，只能根据客观事实，不能以主观臆断为根据;2、公民在法律面前人人平等;3、司法机关依法独立行使职权;4、实事求是、有错必纠。法律依据: 《中华人民共和国立法法》第八十三条同一立法机关制定的法律、行政法规、地方性法规、自治条例和单行条例、规章才能适用一般法服从特别法的原则。而对于不同机关制定的法律规范，应按法律效力等级的要求，即“上位法优于下位法”的原则，适用法律。
