问题	交通肇事罪成立共同犯罪吗
释义	交通肇事罪中存在共同犯罪。但在司法解释中有明确限制，只有单位主管人员、机动车辆所有人、承包人或者乘车人指使肇事人逃逸，致使被害人因得不到救助而死亡的，才以交通肇事罪的共犯论处。其他的不构成。因为交通肇事罪本来就是过失犯罪，不同于故意犯罪。司法解释有规定，是因为法律实施上的特殊需要。法律依据《最高人民法院关于审理交通肇事刑事案件具体应用法律若干问题的解释》第五条该内容由陈雷律师和律说律答共创回答
