释义	法律分析：违法。首先卖的烟，不是从烟草专卖部门获得的有“正经身份”的卷烟，另外国家烟草专卖管理规定，未经烟草专卖行政主管部门许可，擅自经营烟草专卖品，其行为涉嫌非法经营罪。法律依据：《烟草专卖法实施条例》第六十条无烟草专卖零售许可证经营烟草制品零售业务的，由工商行政管理部门或者由工商行政管理部门根据烟草专卖行政主管部门的意见，责令停止经营烟草制品零售业务，没收违法所得，并处以违法经营总额20%以上50%以下的罚款。
