什么是口头合同
释义
法律分析：
口头合同是指当事人以直接对话的方式或者以通讯设备如电话交谈订立的合同。合同的口头形式，无须当事人约定。凡法律未规定或当事人未约定特定形式的合同，均可以采取口头形式。合同采取口头形式的优点是简便快捷，缺点在于发生纠纷时取证因难。所以，对于可以即时清结、关系比较简单的合同，宜采用这种形式。
法律依据：
《中华人民共和国民法典》 第四百六十九条 当事人订立合同，可以采用书面形式、口头形式或者其他形式。
