释义	法律分析：犯法，卖淫不是刑事犯罪，是治安案件，违反的是治安管理处罚法。但是如果卖淫女参加组织卖淫活动的，就会构成犯罪并被处以刑罚。或者是强迫他人卖淫，也构成犯罪。明知自己患有梅毒、淋病等严重性病而卖淫、嫖娼的，即构成传播性病罪，会被定罪处罚。法律依据：《中华人民共和国治安管理处罚法》第六十六条卖淫、嫖娼的，处十日以上十五日以下拘留，可以并处五千元以下罚款；情节较轻的，处五日以下拘留或者五百元以下罚款。在公共场所拉客招嫖的，处五日以下拘留或者五百元以下罚款。
