释义	法律分析：如果普通公民或者单位法人作为原告已经向人民法院提起诉讼，并且人民法院已经受理该案，只要在诉讼判决前，原告都可以申请撤诉。如果原告确定该案需要撤诉，可以直接向法院提交民事撤诉状，也称民事撤诉申请书，提出撤诉申请，法院受理后，会做撤诉处理，并出具相关撤诉裁定书。法律依据：《中华人民共和国民事诉讼法》第一百四十五条宣判前，原告申请撤诉的，是否准许，由人民法院裁定。人民法院裁定不准许撤诉的，原告经传票传唤，无正当理由拒不到庭的，可以缺席判决。
