释义	承租人死亡，租赁合同不能继承。租赁房与租赁合同不属于承租人生前个人所有的合法财产或者是依法可以继承的其它合法财产权益，不能作为承租人的财产进行继承分割，但可以依法由同住人或其他亲属继续与出租人协商承租。法律依据: 《中华人民共和国民法典》第七百三十二条承租人在房屋租赁期限内死亡的，与其生前共同居住的人或者共同经营人可以按照原租赁合同租赁该房屋。《中华人民共和国民法典》第七百三十三条租赁期限届满，承租人应当返还租赁物。返还的租赁物应当符合按照约定或者根据租赁物的性质使用后的状态。
