二、犯故意伤害罪怎么认定
故意伤害罪，是指故意地非法损害他人身体健康的行为，认定为故意伤害罪，其主要特征是：(1)犯罪客体是他人的身体健康。故意伤害自己身体健康的，一般不构成犯罪。但自伤行为损害了社会利益而触犯了其他刑法条文的，则构成犯罪。(2)犯罪客观方面表现为行为人实施了非法损害他人身体健康的行为。
