释义	法律分析: 婚外情行为本身不违法，但是婚外情引起的非法同居行为，重婚行为则构成违法犯罪。如果一方出轨且与他人同居、或与他人重婚的，另一方可以向法院提起诉讼离婚，经调解无效的，法院会判决离婚。法律依据: 《中华人民共和国刑法》第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
