释义	法律分析：如果该少女已满14岁，自愿与成年人发生性关系而发生的，就不是犯法。如果该少女不满14岁而同她发生性关系者，无论该女孩自愿还是不自愿，都要按强奸定罪量刑。法律依据：《中华人民共和国刑法》第二百三十六条对已满十四周岁不满十六周岁的未成年女性负有监护、收养、看护、教育、医疗等特殊职责的人员，与该未成年女性发生性关系的，处三年以下有期徒刑；情节恶劣的，处三年以上十年以下有期徒刑。有前款行为，同时又构成本法第二百三十六条规定之罪的，依照处罚较重的规定定罪处罚。
