释义	法律分析：聚众淫乱罪，指为首聚集三人以上的多人或者多次参加，集体进行淫乱活动的行为。聚众，是指纠集众人，是指由首要分子故意发动、纠集特定或不特定多数人于一定时间聚集于同一地点。聚众的"众"应至少是三人以上(包含三人)，但并非特指三人以上的犯罪人员。如果仅有两人，不能构成本罪。法律依据：《中华人民共和国刑法》第三百零一条聚众进行淫乱活动的，对首要分子或者多次参加的，处五年以下有期徒刑、拘役或者管制。引诱未成年人参加聚众淫乱活动的，依照前款的规定从重处罚。
