非婚生子女的抚养 |

法律分析：
1.男女双方在未经婚姻登记的情况下，解除双方的同居关系时，就非婚生子女由哪一方抚养问题，由双方协商确定。虽然同居关系结束，但本着好聚好散的原则，男女双方可就该问题协商确定子女的抚养权。
2.协商不成时，则根据子女利益最大化及男女双方的具体情况判决。即无论是判决抚养权归哪一方，一个基本的原则是保障子女利益的最大化，需要考量的因素较多，如男女双方的职业、所在的城市、有无房产、有无疾病、是否同祖父母或外祖父母一同生活时间较长等等。
3.哺乳期内的子女，原则上由母方抚养，但如果父方的条件更好，母方同意的情况下，也可由父方抚养。在司法实践中，如果在哺乳期内，母方愿意的情况下，法院一般会支持由母方抚养子女，但如果男方愿意抚养，女方不愿意抚养的情况下，则也可将抚养权判给男方。
4.如果子女已是限制民事行为能力人，即年满8周岁，则子女自身的意见非常重要，如果不是有极为特殊的情况，法院通常会尊重子女的真实想法。
5.如果一方将非婚生子女送他人收养时，必须征得另一方的同意时方可施行。
法律依据：
《中华人民共和国民法典》 第一千零七十一条 非婚生子女享有与婚生子女同等的权利，任何组织或者个人不得加以危害和歧视。
不直接抚养非婚生子女的生父或者生母，应当负担未成年子女或者不能独立生活的成年子女的抚养费。
