法律依据：
《中华人民共和国城乡规划法》 第三条 城市和镇应当依照本法制定城市规划和镇规划。城市、镇规划区内的建设活动应当符合规划要求。
县级以上地方人民政府根据本地农村经济社会发展水平，按照因地制宜、切实可行的原则，确定应当制定乡规划、村庄规划的区域。在确定区域内的乡、村庄，应当依照本法制定规划，规划区内的乡、村庄建设应当符合规划要求。
县级以上地方人民政府鼓励、指导前款规定以外的区域的乡、村庄制定和实施乡规划、村庄规划。
