释义	法律分析：发现埋藏物据为己有构成犯罪。将他人的遗忘物或者埋藏物非法占为己有，数额较大，拒不交出的，构成犯罪。犯侵占埋藏物、遗忘物罪的，处二年以下有期徒刑、拘役、管制或者罚金；数额巨大或者情节严重的，处二年以上五年以下有期徒刑，并处罚金。法律依据：《中华人民共和国刑法》第二百七十条第二款对侵占罪的规定，将他人的遗忘物或者埋藏物非法占为己有，数额较大，拒不交出的，依照侵占罪的规定处罚。
